TERMS AND CONDITIONS OF USE OF QUICKMART APPLICATION

Please read these terms and conditions of use carefully before using the Quickmart Application. By accessing or using the App on any computer, mobile phone, tablet, console, or other devices (together “Devices” and each a “Device”), you hereby confirm that you have read, understood, and agreed to be bound by these General Terms and Conditions (GT&Cs) as well as any other applicable law(s) (the Agreement).

Quickmart is pleased to give you access to the Application along with related or linked websites, applications, services, interfaces, tools, payment platforms, software, and other functionalities provided on or through the Quickmart Application (collectively the “(the App)” by virtue of your agreement to comply with these GT&Cs and our Privacy Policy as contained herein.

Note that: (i) the App may only be used by a person who is 18 years old or over. If you are under 18 years old, please do not use the App or send us any personal data (e.g.: your name, age, address or email address); and (ii) when using the App for payment, you can only receive the payment receipt if you have set your receipt preferences to an email address.

  1. Quickmart may change this GT&C

    Quickmart reserves the right, at its sole discretion, to change, modify, add, or delete portions of this Agreement at any time and without notice to you. In any event that this is done, the new and or the modified version of this GT&C shall be posted on (quickmart.com) and you will be able to see the updated version accordingly. It is your responsibility to regularly check for updates on/changes and review such changes. Any new features or updated content or applications that is made available as a part of the App shall be subject to this GT&C. Your use of the App after any such changes constitute your acceptance of the new GT&C. In some cases, you may be asked to agree to the revised terms when accessing the App and if you do not agree to the revised terms you will not be allowed to access the App.
  2. Agreement effective until terminated

    You may terminate this Agreement at any time by uninstalling the App. Your rights under this Agreement will terminate automatically without notice from Quickmart, if you fail to comply with any of the terms, conditions, or guidelines of this Agreement. Upon the termination of this Agreement, you shall cease all use of the App.

    You understand and agree that some of your user contents may continue to appear on our database or through the App or may persist in backup copies for a reasonable period even after your account and/or access to the App is terminated. Quickmart will close or deactivate inactive customer accounts and close accounts that are used in violation of this Agreement.
  3. Changes to the App
    1. The App is currently made available to you free of charge only for personal, commercial, non-exclusive use. Quickmart reserves the right, in its sole discretion, without notice to you, at any time and from time to time, temporarily or permanently to: (a) modify, change the format, content and/or functionality, suspend, terminate, withdraw, or discontinue all benefits/rewards or the use of any part thereof, without compensation to you, including, but not limited to (i) restricting the time all or any part of the App is available, (ii) restricting the amount of permitted use of all or any part of the App, (iii) deleting accrued reward points, and (iv) restricting or terminating any user’s right to use all or any part of the App; or (b) offer opportunities to some or all users of all or any part of the App. You agree that neither Quickmart nor any of its partners shall be liable to you or to any third party for any modification, suspension, or discontinuance of all or any part of the App, or of any service, acontent, or feature offered on the App.
    2. Updates on the App may be issued from time to time. As a result, you may not be able to use all or part of the App until you have downloaded the latest version of the App and accepted any new terms as may be applicable.
  4. Ownership of the App

    The App (including, without limitation, any material, software, code, files, content, and images contained in or generated by the App, accompanying data, and other embedded software, including third-party software, updates and upgrades of the App, (collectively “the Contents”), — whether in read-only memory, on any other media, or in any other form — are owned by Bestaf Technologies Nig. Ltd. (Bestaf) and its licensors where applicable and are protected by applicable laws. No title or any intellectual property rights are transferred to you. In addition, Quickmart and certain other brands and trademarks, (“the Marks”) are marks of Bestaf or one of its affiliates. Third party marks displayed on the App are owned by their respective owners.

    The Contents are protected by the relevant Nigerian copyright laws and none of them may be copied, reproduced, republished, uploaded, broadcast, posted, transmitted, or distributed except as expressly permitted by Bestaf. Use of Bestaf Contents in any way or for any purpose other than as permitted in this Agreement is a violation of Bestaf’s or any of its affiliate’s copyrights or other proprietary rights and Bestaf shall be entitled to seek legal remedy (ies) as they deem fit. Permission in writing for all other uses of Bestaf’s Contents must be obtained from Bestaf in advance. All content, graphics, and other intellectual property rights, in each case, whether registered or unregistered, other than the marks of third parties, and related goodwill are the properties of Bestaf or any of its affiliates. You understand that you have no rights to the App, Bestaf’s Contents, Bestaf and or its affiliates Marks, or any other Bestaf and or its affiliate’s property except as indicated in this Agreement. Bestaf reserves all other rights with respect to its intellectual property.
  5. Limited right to use the App

    The App is solely designed to enable your use of it for non-profit making, non-exclusive purposes, subject to third-party terms (as described below) Quickmart hereby grants you a limited, revocable license (note that you do not have right to sub-license your right to use the App) to use the App as provided in this Agreement. This license entitles you to install the App on your device and to use the App subject to this Agreement. Further, this Agreement does not grant you any rights to use Bestaf’s proprietary interfaces and other intellectual property in the design, development, manufacture, licensing, or distribution of third-party devices and accessories for use within the App. The unauthorized use of the App including, without limitation, resale, transfer, modification, or distribution of the App or copying or distribution of text, pictures, music, video, data, hyperlinks, displays, and other content provided by the App is highly prohibited.
  6. Quickmart may collect information about you when you use the App

    While using the App, Quickmart may record information including, but not limited to your geographic location, device address, type of device, your device’s unique ID, the IP address session, time, network status and relevant information regarding your use of the App (“Device Information”). Your use of the App constitutes your consent to allow Quickmart to process and record your Device Information. However, such information shall not by any means whatsoever be stored in Quickmart’s database.
  7. To use the App, you must:

    (a) create a Quickmart account; and

    (b) have an internet-enabled eligible electronic device which is connected to the internet and uses a software version that supports the App.

    1. You must ensure that all information that you provide when you create the Quickmart account and use the App is accurate, up to date and not misleading. You shall be required to provide your name, date of birth, email address, and payment credentials and you must provide accurate and complete information in response to these questions.
    2. You may incur and are solely responsible for charges from your mobile phone network operator for downloading and using the App and the Services.
    3. When you are at any Quickmart’s authorized petroleum products Service station, you may only use your mobile device, including the App, while in your stationary vehicle. You must not use your mobile device whilst driving or outside your car on the forecourt of the station.
  8. Keeping your Quickmart account safe & secure
    1. When you set up your Quickmart account, you will be required to create an account password.
    2. If you use any service(s) on the App (or any additional Services that Quickmart adds to the App that requires additional security) you may be required to, or have the option to create an additional PIN or any other additional security measure of your choice and at your disposal.
    3. You are responsible for ensuring that:

      (a) you are the only person that uses your Quickmart account – you are advised not authorize anyone else to use your Quickmart account;

      (b) you only log onto your Quickmart account on one device at any time;

      (c) your password and PIN are kept secure - for example, you must not tell anyone else your password or PIN. You are advised not to keep your password or PIN as a written or electronic record on your mobile device or any device; and

      (d) your Quickmart account information is updated if your details change – for example, it is essential that you update your mobile phone number or email address if it changes in order to continue to use your Quickmart account and your payment method (i.e Visa, Verve or Mastercard,), if you are using the services. Quickmart is under no obligation to check that any instruction or confirmation made through your Quickmart account is from you and Quickmart is only liable, after the receipt and acknowledgement of the receipt of appropriate notice, for any loss or damage arising from your failure to keep your password and PIN secure in the circumstances described in clause 8.4 below.

    4. You must notify Quickmart immediately by calling (insert customer care number), and request cancellation or temporary suspension of your Quickmart account (Cancellation Request), if the security of your Quickmart account is compromised due to:

      (a) your mobile device being lost or stolen;

      (b) your password and/or PIN becoming or likely to become known by another person; and/or

      (c) unauthorized access to your Quickmart account.

      In addition, you must confirm these notification by email to Quickmart via (insert email address) within 24 hours but before any unauthorized transaction on your account.

    5. Quickmart shall not be liable for any transactions on your Quickmart account prior to the Cancellation Date which shall commence 24 (twenty-four) hours after the receipt of the request.
    6. Quickmart may:

      (a) enforce or implement any security measures it deems appropriate; or

      (b) update and add security measures, to the Quickmart App at its discretion at any time.

    7. The security of your Quickmart account is important to Quickmart. However, Quickmart cannot guarantee that the App shall always be available, fault-free and secure or that it will be free from viruses or other harmful programmes. You acknowledge that you are aware of, and accept this risk, including, without limitation to the risk that a third party may gain access to your Quickmart account, which contains personal and confidential information.
  9. Expiration of Voucher

    Upon purchase of any item on the App, a voucher will be generated to confirm the transaction. However, where the voucher is not utilized within 48 (forty eight) hours, the voucher will expire and the money value will be returned to the Quickmart’s account.
  10. Use of Personal Information

    Any information obtained from you with respect to your use of the App will be held in strict confidence. However, Quickmart shall not be held liable for any information that: (a) is lawfully known to the Receiving Party without binder of secrecy; or (b) is publicly available and shall cease to apply to any Confidential Information which, after it is received or obtained by the Receiving Party, (c) is received or obtained by the Receiving Party without restriction on disclosure from a source free to disclose it other than the Disclosing Party; (d) becomes publicly available through no act or omission on the part of the Receiving Party; or (e) was independently developed by the Receiving Party.
    1. Quickmart will use your personal information, which includes:

      (a) your name, contact details, payment method details and other information that you provide when registering to use the App;

      (b) geographic information when you use or have the App running;

      (c) transaction information relating to your use of the App (including transaction type, date, time and value);

      (d) information about your use of the App and your settings preferences; and

      (e) information about your mobile device, for the purpose of providing our services related to the App (including for the purpose of personalizing those services), processing payments and administering your account, providing you with recommendations (including personalized recommendations) in relation to Quickmart’s products or services and other marketing related purposes, conducting checks on your transactions and account (for example credit card fraud checks) and for dealing with your enquiries and requests. Where Quickmart holds personal information about you that it has collected from different sources, it may combine such personal information into a single record. If you choose not to provide your personal information, you may not be able to use some or all of the services available on the App, receive updates from Quickmart or have Quickmart answer or respond to your enquiry or request.

    2. We will collect your personal information from you where possible, but where relevant we may also collect your information from third parties (such as our service providers who collect your personal information on our behalf as part of the functionality of the App and our commercial partners and third parties who are involved in providing any benefit, reward or service to you). If this occurs, we will take reasonable steps to ensure that you are aware of the matters contained in this privacy notice. If you provide us with the personal information of another person (such as a family member or work colleague), you must make them aware of the matters contained in this privacy notice.
    3. Where you agree to receive such communications, Quickmart may keep in contact with you by post, email, in app notifications or SMS about topics which we reasonably believe are of interest to you. You can opt-out of receiving future marketing communications at any time by contacting us at (insert email address), updating your settings in the App, or using the unsubscribe link on a marketing email.
    4. Your personal information may be disclosed to:

      (a) outsourced service providers and marketing organizations (and have those third parties collect your personal information on our behalf via their software(s));

      (b) our commercial partners and other third parties who provide any benefit, reward or service to you (either directly or on our behalf); and

      (c) suppliers, dealers, distributors and other third parties with whom we have commercial relationships, for the purposes set out in this notice and other related business and marketing purposes. If you have consented to receiving marketing materials from our commercial partners and other third parties who provide any benefit, reward or service to you, then these parties may use the personal information that we disclose to them (together with any other personal information held by those third parties about you) to send personalized offers directly to you in relation to their own products and services, and/or in relation to our products and services (when those offers are sent to you by those third parties on our behalf but through Quickmart).

    5. We may also disclose your personal information to our related bodies corporate, contractors, service providers and agents and also to government bodies and regulatory authorities (where required and or authorized by law).
    6. In some circumstances, we will hold your personal information in, or disclose your personal information to our related bodies corporate and service providers located in, countries outside Nigeria including any other countries listed in our privacy policy or in which Quickmart operates in from time to time.
    7. We will otherwise collect, hold, use and disclose your personal information in accordance with Quickmart’s Privacy Policy, which sets out how you may access and correct the personal information that we hold about you and how to lodge a complaint relating to our treatment of your personal information (and how Quickmart will handle such a complaint). Quickmart’s privacy policy may be updated from time to time. You are hereby advised to always review policy for your information.
  11. Refer a Friend

    The Use of this feature on the App entitles you to referral bonus (es) of N100.00 However, to be eligible for the referral bonus, your referral must have signed up on the App with your code, registered on the App and purchased products up to N……….. minimum.

    Upon signing up and successful purchase of Products of not less that the above stated amount on the App, the new user earns 100 reward points which can be used to purchase more products.

  12. Use of i-witness Feature

    All information obtained by the App user via the i-witness feature is solely for reporting concerns to Quickmart for appropriate action. However, Quickmart is not liable for the use by the App user of such information for purposes other than the aforementioned purpose.

  13. Third party terms
    1. Quickmart uses third party applications, services and software in the App, including, but not limited to, payment services, location and map services software, market analytics software, market intelligence software, and rewards program software, all of which may gather and report information about you in connection with your use of the App (such as location information, device information and user content).
    2. When you use the App, you are agreeing to Quickmart’s use of such third party software and services. Similarly, you are also agree to any applicable terms of use, licenses, or privacy policies related to such third party software and services. It is your responsibility to ensure that you comply with any related third party terms, including the third party privacy policies notified to you in Quickmart’s Privacy Policy (insert link), and that you are aware of any third party privacy policies that may apply to you, in conjunction with these Terms. A violation of any such terms of use, copyright or privacy policy shall be deemed to be a breach of these Terms.
  14. Termination
    1. You can delete the App on your mobile device at any time. You must notify Quickmart by email to (insert email address) if you wish to permanently delete your Quickmart account. By cancelling your Quickmart account, your login details and other information contained within the App and any other Quickmart Services using the same login details will be permanently deleted.
    2. Quickmart reserves the right to suspend or immediately terminate the usage of the App, any of the Services, any functionality of the App, or your specific Quickmart account at any time, with or without cause or notice.
    3. Where Quickmart suspends or terminates your Quickmart account as a result of a breach of these Terms by you, you are not permitted to create a new account to circumvent the suspension or termination. Quickmart may at any time permanently block an individual from creating or administering a Quickmart account at its sole discretion if it has reasonable cause to do so.
    4. All provisions of the Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, indemnities and limitations of liability.
  15. Liability
    1. To the extent permitted by law, in no event shall Quickmart, nor its directors, employees, agents, partners or any other party involved in creating, producing or delivering the App (Representatives), be liable under contract, tort (including negligence) or otherwise under or in connection with these Terms and/or your use of or inability to use the App and any of the Services.

      This applies, without limitation, to any loss or damage which you may suffer as a result of:

      (a) any third party software and services embedded in the App

      (b) any bugs, viruses, Trojans, or the like (irrespective of its origin);

      (c) the actions or inactions of other App users;

      (e) the acts or omissions of participating retailers;

      (f) suspension or loss of access to the App or any functionality; and/or

      (g) unauthorised use or misuse of your Quickmart account for any reason where Quickmart has not received written notice of cancellation in accordance with clause 8.4.

    2. You hereby indemnify Quickmart against any claims, costs, damages, losses, liabilities, expenses or legal proceedings brought against Quickmart or its Partners by any other person as a result of either the authorized and or the unauthorized access to your Quickmart account and/or your use of the App in breach of these Terms or any third party terms (see clause 8 above).
    3. You acknowledge that the App is provided at no charge and accordingly the exclusions of liability and indemnity set out in this clause are fair and reasonable.
  16. Changes to these terms
    1. Subject to the remainder of this clause, Quickmart may amend these Terms from time to time by publishing an updated version on the App. Please check the terms published on the App periodically for changes as your continued use of the App following the publication of updated Terms confirms your acceptance of the updated Terms.
    2. The changes Quickmart can make to these Terms, without your authorization, are limited to changes: (a) to reflect updates to the functionality, security, options and Services available on the App; (b) to reflect third party terms and conditions that apply to Quickmart and/or the App; (c) that are generally beneficial to, or do not have any adverse impact on the users of the App; and/or (d) that are required to reflect changes to applicable law.
    3. The App shall request for your confirmation that you agree to the updated Terms if the updated Terms incorporate any other changes. Your continued use of the App shall be subject to your confirmation that you agree to the updated Terms.
  17. General
    1. You must comply with any additional terms and conditions brought to your attention on the App, when setting up your Quickmart Account or using the App.
    2. You agree that:

      (a) you shall not assign or otherwise transfer your Quickmart account to any other person;

      (b) you shall not use the App for any unlawful purpose, in any way that interrupts, impairs, damages or renders the App less efficient, to transfer files that contain viruses, Trojans or other harmful programs, to access or attempt to access the accounts of other Quickmart account holders or to penetrate or attempt to penetrate any security measures;

      (c) you shall not do anything Quickmart reasonably considers to be disreputable or capable of damaging its reputation, the App or the Services; and

      (d) you shall comply with all applicable Nigerian laws.

    3. In the event that any provision of these Terms is declared to be unenforceable or invalid, that provision will be removed to the minimum extent necessary so that the remaining provisions will otherwise remain in full force and effect. The failure of Quickmart to exercise any right shall not be deemed a waiver of that right or any other rights that it may have.
    4. These Terms are governed by and construed in accordance with the laws of Nigeria and you submit to the exclusive jurisdiction of the Nigeria Courts.
    5. These Terms constitute the entire agreement between you and Quickmart in relation to the use of the App.

    If you have any questions about these Terms or the App, or wish to notify us of any of the matters referred to in these Terms, please contact Quickmart at (insert email address). If you do not agree to these Terms and Conditions of Use, please do not access or use the App or any of its functionality thereof.

TERMS AND CONDITIONS OF QUICKMART’S RAFFLE DRAW

This Raffle (“Buy Ticket and Win Promo”) is organized and managed by Bestaf Technologies Nig. Ltd (Bestaf) for the sole aim of raising funds for charity. At the end of the Raffle draw(s), Quickmart/Bestaf shall donate all the proceeds of the Raffle to charity as it shall deem fit.

  1. Qualification for Raffle

    The Raffle shall run on the Quickmart App (‘the App’) and it is open to all the App users in Nigeria who are up to 18 years and above. To qualify for the Raffle, participants must have purchased a range of Quickmart products from any Quickmart’s authorized dealers in Nigeria or any accredited Quickmart’s distribution outlets and thereafter, purchase the Raffle tickets on the App to qualify for the draw.

    The requirement to qualify for the Raffle is the purchase of any of Quickmart’s products listed on the Raffle Offer, topping up of wallet, complete redemption of vouchers (and any other requirement as Quickmart shall deem fit from time to time) whilst the offer is still valid or one (1) month prior to the Raffle Offer. Upon the fulfillment of any the above requirements, a participant stands a chance to win any of the gift items designated for the category of the draw. One purchase only of any of the above-mentioned products and or one ticket entitles a participant to one entry into the draw. On the other hand, multiple entries increases the participants’ chances of winning a prize.

  2. Eligibility

    People who fall under the following categories are exempted from participating in the draw:

    i. Employees (and family members) of Bestaf, MRS, their affiliates and subsidiary companies, and representatives or agents; and

    ii. Anyone person professionally connected with the Raffle and their family members.

    For the avoidance of doubt, family members referred to above include but are not limited to: spouse, ex-spouse, child or stepchild, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister, or cousin. Each participant is obligated to disclose any potential conflict of interest that may arise as a result of his/her participation in the Raffle. I.e. the existence of any family, professional or other relationship, which could cause his or her perticipation to be questionable.

  3. Prizes

    Prizes include:

    To claim a prize, participants must present valid identity cards and show automatically generated emails from Quickmart as proof of selection. The prizes will be awarded as described within the Raffle and are not convertible to cash.

  4. Winners

    i. The draw shall be electronic-based. Successful participants will be notified immediately after the draw has been conducted via email. If after entering the Raffle, any participant is subsequently found ineligible to participate in the Raffle, Bestaf may at its sole discretion, forfeit or reclaim the prize and either award it to such person or dispose of it as it deems fit.

    ii. The redemption and/or distribution of prizes to winners will be conducted at the nearest Quickmart’s authorized Stores. All prizes shall be distributed and collected within two (2) weeks of Quickmart contacting the winners. Failure to collect the prizes within the specified dates will result in forfeiture of the prize at Quickmart’s discretion.

    iii. A winner may be required to take part in publicity related to the Raffle including having his or her photograph taken and his or her name, nationality, and country of residence. Where this is the case, the winner consents to the disclosure of his/her information.

    iv. Winners are responsible for any tax liability (where applicable) in respect of the prizes.

    v. Reproduction and image adaptation of participants on print media, social media platforms, file sharing websites, intranet, and extranets by Quickmart may occur. Such images may be used for a maximum period of ten (10) years.

  5. Confidentiality

    "Confidential Information” includes all information of any kind, including administrative, commercial, technical, scientific, financial, legal, tax, and economic information that has been, or will be transmitted directly or indirectly by Quickmart to the participants, or to which the participant has had, has or will have access to further to the Raffle, including but not limited to any verbal, written or electronic documents. The following does not constitute Confidential Information: (i) Information that is currently or becomes accessible to the public without any breach of the terms of these Rules on the part of the Participant, (ii) information that is lawfully held by the Participant before it is disclosed by Quickmart without any obligation of confidentiality, and (iii) information that is duly obtained from a third party who is authorized to transfer or disclose the said information.

    Participants hereby agree not to use or disclose the Confidential Information other than in relation to their participation in the Raffle, for the duration of the Contest and for a period of two (2) years thereafter.

  6. Ethics

    Quickmart undertakes to comply with the anti-corruption and fraud rules.

  7. Modification, suspension, or cancellation

    Quicksmart or Bestaf shall not be liable if, in the event of force majeure or events out of its control, the Raffle is canceled, postponed, suspended, modified or shortened. Quicksmart or Bestaf reserves the right of extending the participation period and to postpone any date or time announced. Additions and modifications to these Rules may be made by Quicksmart or Bestaf before or during the draws. They will be considered additional clauses to these Rules and any change(s) will be communicated accordingly. The participant is considered to have accepted these modifications by virtue of his/her participation in the draws.

    Quicksmart or Bestaf may cancel the entire Raffle or a part of it if fraud appears to have occurred in any form whatsoever, especially in the framework of participation. In this event, Quicksmart or Bestaf reserves the right not to award a prize to those responsible for the fraud, the right to reclaim the prize in the event that fraud is discovered after it is awarded, and/or to take legal action against those responsible for or involved in the fraud.

  8. Liability

    i. Quicksmart or Bestaf shall not be held liable for any direct or indirect damage or loss relating to the prizes or the Raffle. The results of the Raffle are not subject to appeal.

    ii. By virtue of Quicksmart or Bestaf’s sole discretion to modify the terms of the Raffle at any time, there shall not be any liability incurred on the part of Quicksmart or Bestaf as a result of any modification. Participants are advised to regularly consult these Rules and the website regularly. Participants expressly waive all claims and disputes relating to any changes made to the Rules by Quicksmart or Bestaf.

    iii. Quicksmart or Bestaf declines any liability for any incident or accident that may occur to the participants during participation in the Raffle or during the use and/or enjoyment of the prizes.

  9. Exclusion right

    i. Quicksmart or Bestaf reserves the right to exclude rightfully and without notice, any participant who does not comply with these Rules and cancel all accrued rights of the participant.

    ii. Quicksmart or Bestaf shall cancel any prize caused by a technical malfunctioning of the selection platform. This cancelation may be done at any moment and without notice.

    The Participant also recognizes the right of Quicksmart or Bestaf to remove and cancel the participation in the Raffle of any Participant who will have created or used a method aiming to gain, by an unfair and irregular way, prizes or whatsoever, on the selection platform. The Participant’s account removal could be done at any moment and without notice and no claim shall be accepted.

  10. Non-Partnership

    Participation in the Raffle does not create any relationship of partnership or otherwise between Quicksmart or Bestaf and Participants.

  11. Claim

    Any claim in relation to the Raffle shall be sent by email to the email address …………………. However, Quicksmart or Bestaf reserves the right to refuse to act on claims it considers inappropriate.

  12. Evidence

    Evidence of any act, including in particular, the Participants' acceptance of these Rules, and any fact or omission, may be produced in the form of programs, data, files, recordings, operations, or other information of a computer or electronic nature, or in or on a computer or electronic format or media, established, received, or stored directly or indirectly by Quicksmart its information systems. Participants agree not to contest the admissibility, validity, or probative value of the aforementioned information, on the basis of any legal provision whatsoever. Accordingly, such information constitutes evidence and, if it is produced as evidence in any litigation or other proceedings, it will be admissible, valid, and enforceable against the parties in the same way, in the same conditions, and with the same probative value as any document established, received, or stored in writing.

  13. Warranties and Indemnities

    i. The participants warrant that by participating in the Raffle, they have accepted and are bound by these terms and conditions.

    ii. The Participants indemnify Quicksmart or Bestaf and any other person or party associated with the Raffle against any loss or damage (including but not limited to indirect or consequential loss or damage) which may occur in connection with either participating in the Raffle or with the prizes offered.

  14. Governing Law

    These terms and conditions of the Raffle shall be governed by the laws of the Federal Republic of Nigeria.

    By accepting these Terms and Conditions, the participant agrees to all the information stated above.
